President-elect Donald Trump’s legal team has asked the court to cease proceedings on his election subversion case in Georgia, citing his return to the White House.
“A sitting president is completely immune from indictment or any criminal process, state or federal,” Wednesday’s filing states.
In keeping with Trump’s continued attacks on Fulton County District Attorney Fani Willis, who has overseeing the case against the incoming president, the request also argues there’s “compelling evidence of local bias and political prejudice against the President by the local prosecutor,” and accuses Willis of “acting in clear opposition to the will of the citizens of Georgia.”
His lawyers also argue that it’s a “jurisdictional issue” to have local leaders move forward with criminal proceedings against a sitting president.
The move, which follows the post-election trajectory of his three other criminal cases, comes a few weeks after the court canceled oral arguments that were supposed to begin on Thursday.
